Supporting your BSA Compliance

  • To help ensure that the Building Safety Act requirements are embedded into your steady state operations, we will conduct a light touch but targeted Building Safety Act audit.

  • We audit your agent’s policies, procedures and information held on the buildings they manage from a BSA perspective. This will help you understand the progress towards compliance its agents have made.

  • Reviewing your existing framework property management agreement to understand what duties your agent is responsible for and whether it captures the enhanced requirements and responsibilities deriving from the Building Safety Act. We will identify BSA deliverables and draft a schedule setting out the requirements in order that buildings can be managed in accordance with the requirements of the Act. We will align this with Key Performance Indicators and financial incentives/penalties.

  • Identifying BSA specific risks around new development and map the points at which they are likely to occur. This will include written statement of commercial risks and suggestions on how these might be mitigated in Purchase Agreements.

  • Working with the team negotiating asset purchase agreements we will identify the critical BSA/Golden Thread deliverables required to pass through the Gateways and deliver a compliant building at handover.

  • It is important that protocols are in place between the Principal Accountable Person and its agents to ensure that urgent BSA related issues are priortised and reported to you in order that the business can engage with these issues and meet its PAP obligations under the BSA.

    We will produce a ‘safety management urgent communication tracker’ that incorporates template forms, procedures and reports that the agents will be expected to complete, update and share with you.

  • Working with your operational team, we will determine the extent of your activities that may fall within the BSA’s scope, to put in place a framework that helps you identify training requirements for individual roles within the business, and record and maintain a schedule of current and proposed training.
